Regarding solar panels... A new decision by Energy and Interior

Minister of Interior and Municipalities Ahmed Al-Hajjar, Minister of Public Works and Transport Fayez Rasamni, and Minister of Energy and Water Joseph Al-Sadiq issued a decision concerning the mechanism and conditions for installing solar panels with a production capacity of less than 1.5 megawatts, in order to preserve environmental requirements, public safety, and public health,
And the decision stated:
Article One: Scope of Application of the Decision
This decision determines the administrative conditions for requests to install solar panels with a production capacity of less than 1.5 megawatts, in addition to environmental, public health, and public safety requirements that remain in effect until procedures and standards in this regard are issued by the Electricity Sector Regulatory Authority in application of Article /26/ of Electricity Sector Regulation Law No. 462/2002.
Article Two: Mechanism for Submitting Applications and Required Documents
Requests to install solar panels with a production capacity of less than 1.5 megawatts shall be submitted to the concerned municipality or the Qaimmaqam in towns where there is no municipality, by the concerned party (the owner, the legal occupant, their legal agent) accompanied by the following documents:
1- Solar panel installation request form (according to the approved model).
2- A liability statement issued and signed by:
* A structural engineer duly registered in the Order of Engineers (Beirut or Tripoli).
* An electrical or electromechanical engineer duly registered in the Order of Engineers (Beirut or Tripoli).
3- An easement and zoning statement issued by the departments of the Directorate General of Urban Planning.
4- The approved form from the Order of Engineers proving the availability of the required engineering and technical specifications.
5- If the installation takes place on common parts of a building, a map showing the location of the panel installation and the distribution of the roof area among the owners must be attached, along with the approval of the owners' association for this distribution, provided that in the absence of an owners' association, the approval of 75% of the owners must be attached while preserving the rights of all owners benefiting from the top roof or the common part.
6- Approval of the owner of the section if the applicant is the tenant or occupant of the property.
Article Three: Technical Conditions
1- If the requested installation is located on the top roofs of buildings, the following must be met:
* The maximum height of the solar panels must not exceed 3 meters from the level of the top roof in buildings with a height of less than 15 meters.
* The maximum height of the solar panels must not exceed 4.5 meters from the level of the top roof in buildings with a height of more than 15 meters.
* In all cases, it is not permissible to install solar panels above the stair cage as it is not considered a top roof of buildings.
2- If the requested installation is located on natural ground, the following must be met:
* The height of the highest edge of the solar panels above the natural ground must not exceed two meters (2m).
* The height of the lowest edge of the solar panels above the ground must not exceed 40 cm.
* In all cases, the panels must be installed at a suitable slope to receive sunlight.
3- In all cases, if these dimensions and heights are exceeded, the installation of the panels shall be considered metal structures subject to the provisions of the Building Law and zoning regulations, particularly regarding calculating them within the surface exploitation rate, the general exploitation factor, the maximum height, and the number of floors specified for the property.
4- In the presence of a tile shed or sloping roof, it is stipulated that the solar panels must be in contact with the covering of the shed or sloping roof.
Article Three: Review of Applications
1- The concerned municipality or the Qaimmaqam shall verify the completion of all required administrative and technical documents after registering the application with it, and it may request the concerned party to complete any shortcomings when necessary.
2- Applications shall not be accepted for properties where works are suspended due to a building violation or for any other reason, unless the violation is removed or regularized in due form.
3- The municipality or the Qaimmaqam must decide on the application within a period of fifteen days from the date of its registration or completion by the concerned party. In the event of rejection of the application, it shall be returned to the office of the municipality or the Qaimmaqam to notify the concerned party through administrative channels with the reason for rejection stated. In the event of its silence, the application shall be deemed implicitly accepted and the concerned party has the right to commence the installation of solar panels after paying the required municipal fees.
4- A copy of the approval shall be kept in the archives of the municipality or the Qaemmakamiyat, a copy shall be delivered to the concerned party, and a copy shall be sent to the Ministry of Energy and Water for information.
5- The municipality or the Qaimmaqam shall collect a lump-sum fee for the solar panel installation works in accordance with the provisions of Article 81 of the Municipal Fees and Surcharges Law issued on 12/8/1988 and its amendments.
Article Four: Supervision of Implementation
1- The two signatory engineers (structural and electrical or electromechanical) shall supervise the implementation of the solar panel installation works.
2- After completion of implementation, the two engineers shall submit a final statement on the usability of the installed system and its compliance with public safety conditions from an urban and technical perspective (according to the approved model).
Article Five: General Provisions
1- The role of the Order of Engineers is limited to ratifying the signatures of engineers on the plans and agreements attached to the file in accordance with the provisions of the Engineering Profession Regulation Law, while issuing approval falls within the jurisdiction of the municipality or the Qaimmaqam.
2- The role of the municipality is limited to verifying the availability of administrative, urban, engineering, and public safety requirements in granting its approval for the application in accordance with the provisions of the Building Law and the legal texts related thereto.
3- The Internal Security Forces and the municipal police shall assume the responsibility of cracking down on violations resulting from installation works that conflict with the provisions of this decision.
4- The concerned party must commence the implementation of the approved application and complete the installation of the solar panels within a period of one year from the date of being notified, failing which the approval shall be considered automatically null and void, requiring thereafter the submission of a new application to the concerned municipality.
Article Six:
This decision shall be communicated to whomever it concerns and shall enter into force immediately upon its publication.
